TERMS AND CONDITIONS OF SALE

These Terms and Conditions govern the sale of goods by I Ate Civilisation, a trading name of Backstreet International Merchandise Ltd, to customers placing orders through our website.

Please read these Terms carefully before placing an order. By completing a purchase, you agree to be bound by these Terms.

These Terms do not affect your statutory rights. See Section 14 for full details.

1. COMPANY DETAILS

I Ate Civilisation is a trading name of Backstreet International Merchandise Ltd, registered in England and Wales under company number 2597733. VAT number: GB 549 048522.

Registered office address: 1a High Street, Epsom, Surrey, KT19 8DA, UK.

Please note: this address is our registered office only. Returns are not accepted here. See our Shipping, Returns & Refunds Policy for return instructions.

We may update these Terms at any time. The version in force at the time of your order will apply to that purchase.

 

2. FORMATION OF CONTRACT

Orders may be placed via our webstore. A binding contract is formed when we accept your order. Receipt of an order confirmation email does not constitute acceptance — acceptance occurs when payment is received and cleared.

You are responsible for ensuring all order details are correct at the time of purchase. If you notice an error after placing your order, please contact us immediately via the Contact link in the site footer. We will try to accommodate amendments where the order has not yet been sent to production, but we cannot guarantee changes can be made once processing has begun.

We reserve the right to cancel orders suspected of being placed for commercial resale, or using false or invalid information. Any refund due will be issued promptly.


3. FORWARDING ADDRESSES

We do not knowingly ship orders to freight forwarders or third-party forwarding addresses. Orders suspected of being shipped to forwarding addresses may be cancelled and refunded. In the case of recorded music, orders to forwarding addresses are excluded from chart reporting.

If we do dispatch to a forwarding address (whether knowingly or not), we cannot accept liability for loss, damage, tampering, or non-delivery that occurs after the parcel has been received by the forwarding service. Your statutory rights under UK consumer law are not affected by this clause.


4. CANCELLATIONS & RETURNS

UK and EU customers have the right to cancel their order under the Consumer Contracts Regulations 2013 (UK) and the EU Consumer Rights Directive. Full details are set out in our Shipping, Returns & Refunds Policy, which forms part of these Terms.

Key points:

  • You may cancel within 14 days of receiving your goods, for any reason.
  • You then have 14 days to return the goods.
  • Refunds will be processed within 14 days of us receiving the returned items.
  • Return shipping costs are your responsibility for change-of-mind returns. We cover return costs for faulty, damaged, or incorrect items.
  • Items must be unused, in original packaging, and suitable for resale.

Personalised or custom items

Personalised or custom-made items are non-returnable and non-refundable, except where they are faulty, damaged, or do not match the agreed specification. Please check all custom details carefully before ordering.

Pre-order cancellations

Pre-orders may be cancelled at any time before dispatch. Once dispatched, standard cancellation and returns rights apply.


5. PRICE & PAYMENT

Prices are as shown at checkout at the time of ordering. Delivery charges are shown at checkout prior to payment. Payment must be made by credit card, debit card, or PayPal. Goods will only be dispatched against cleared funds.

UK customers will be charged VAT at the applicable rate. Customers outside the UK are responsible for any customs duties, import taxes, or local charges that may apply on delivery. US orders are shipped Delivered Duty Paid (DDP) — see our Shipping Policy for details.


6. OUT OF STOCK

High demand may occasionally result in an item becoming unavailable after your order is placed. If we are unable to fulfil your order, we will notify you as soon as possible and issue a full refund, including any delivery charge paid, within 3–5 business days.


7. PRODUCT DESCRIPTIONS

All product descriptions, images, and specifications are provided in good faith. Minor colour variations may occur due to screen settings and printing processes.

If you receive goods that do not match the description on our website, please contact us. You are entitled to a remedy under the Consumer Rights Act 2015.


8. LIABILITY

Our liability to you is limited to the purchase price of the goods ordered.

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any breach of the implied terms under the Consumer Rights Act 2015 (including that goods will be of satisfactory quality, fit for purpose, and as described)
  • Any other liability that cannot be excluded by law

We are not liable for any indirect losses, loss of use, loss of revenue, or loss of profit arising from your purchase.


9. EVENTS BEYOND OUR CONTROL

We are not liable for any delay or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, including but not limited to: strikes, industrial disputes, system or network failure, floods, fire, explosion, or acts of government.


10. SPECIAL OFFERS & PROMOTIONS

Special offers are valid only during the dates specified and cannot be combined with other discounts unless explicitly stated.

Competitions and prize draws

From time to time we may run competitions, prize draws, or similar promotions ('Promotions'), either directly or with third parties.

  • No purchase is necessary to enter or win unless otherwise stated.
  • Each Promotion will have its own rules, which take precedence over these Terms in the event of conflict.
  • Prizes are non-transferable and non-exchangeable for cash unless stated otherwise.
  • Employees of BSI Merch, its affiliates, and prize suppliers (and their immediate families) are excluded from entry.
  • Winners may be asked to consent to publicity use of their name and country of residence.
  • Personal data collected in connection with Promotions will be processed in accordance with our Privacy Policy.


11. SAFE WORKPLACE POLICY

We have a zero-tolerance policy towards threatening, abusive, or harassing behaviour directed at our staff. We reserve the right to terminate communication, cancel orders, and refer incidents to the relevant authorities where behaviour of this nature occurs.


12. DATA PROTECTION

We may send promotional communications to customers who have opted in. We do not sell or share customer data with third parties for marketing purposes. For full details, please see our Privacy Policy.


13. GENERAL

Governing law

These Terms are governed by English law. Both parties submit to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights as a consumer under the law of your country of residence.

Partial invalidity

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.

Waiver

Failure by us to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign your rights or obligations under these Terms without our consent. We may assign our rights to affiliates or successors without notice.

Third party rights

No third party has any rights under these Terms.

14. YOUR STATUTORY RIGHTS

Nothing in these Terms and Conditions affects your statutory rights as a consumer. Under UK and EU consumer law, you have the right to goods that are of satisfactory quality, fit for purpose, and as described. You also have rights to cancellation and return under the Consumer Contracts Regulations 2013 and equivalent EU legislation. These rights exist independently of anything stated in our policies.
